FMCSA says revised DataQs reviews are in place nationwide

The agency outlines three review stages and response timelines for disputed safety data.

FMCSA said on October 16 that all 50 states, Washington, D.C., and U.S. territories meet its revised DataQs requirements. The system lets drivers and carriers seek review of safety records they believe are wrong or incomplete.

What the agency describes

The framework has initial review, independent reconsideration and final review. FMCSA lists completion standards of 21 days for initial review, 21 days for reconsideration and 45 days for final review. Decisions must explain the evidence considered and the next steps.

The bulletin says states must review requests filed within three years of an inspection or five years of a crash.

Keep the dates straight

October 16 is the announcement date. The bulletin reports nationwide implementation; it does not identify that date as a new rule’s effective date. A review request is not a guarantee that a record will be corrected.
